Entitlements are a vested right granted to property owners by local jurisdictions allowing them to use or develop their property in a specific way. Once granted, these rights cannot be taken away. The perception of risk associated with the land development industry has to do with the lack of certainty associated with a proposed project. Entitlements change all of that. Entitlements add certainty, and certainty adds value! On a recent consulting call, I was speaking with a member of this group about an issue he ran into with the county. The county told him that the mobile home located on the property was considered an unapproved (illegal) structure/land use. When it comes to the legal status associated with any particular structure or land use, there are primarily three types of classifications that apply; legal land use; legal non-conforming land use; and unapproved (illegal) land use. In this case I was able to help them identify and locate the proper documentation to have the classification changed to legal non-conforming which helped him retain much of the anticipated value in the property. A density bonus provides an increase in allowed du/ac, Floor Area Ratio (FAR) or height which generally means that more housing units can be built on any given site. This bonus is typically granted to a developer in exchange for the provision of affordable and sometimes age restricted (55+) communities. This doesn't just have to be for larger projects. It can be done for smaller ones as well. Another example of how unique entitlements can add value to an existing property
